Annexure 3: Policies
Placement Policy

Permanent Placement: Permanent Carer/Domestic’s are required to work thirty (30) hours or more each week.

The Carer/Domestic is engaged on a continuing basis and can expect the placement to continue for twelve (12) months or more. Entitles will include superannuation if working thirty (30) hours or more, plus annual leave, sick leave & public holidays.

Part Time Placement: Part Time Carer/Domestic’s are engaged on a continuing basis and can expect the employment to continue for a reasonable time.

The Carer/Domestic is engaged for the same period of time on regular days and is paid at the end of each week as per Agreement prior to the Placement.

The Carer/Domestic is entitled to superannuation if working thirty (30) hours or more per week and is also entitled to pro rata annual and sick leave.

Temporary Placement: Are undertaken with the following Agreements

When a Carer/Domestic in a Temporary Placement leaves the Clients Employment within the Invoicing Period and the Agency cannot find a replacement Carer/Domestic the Agency will give a refund for each week the Carer/Domestic did not complete or work.

The Agency deems a Temporary Placement as stated in the Placement Fee Structure is based on the number of weeks the Client initially requests.

The Agency deems a Temporary Placement is satisfactory after two (2) days unless the Client notifies the Agency in writing to the contrary within twenty four (24) hours from the start of the Temporary Placement. No refund will be payable should a Carer/Domestic be terminated after two (2) days of the Placement.

The Agency deems no refund or deduction from the Agency’s Fees will be given to the Client if the number of weeks is subsequently reduced on a Temporary Placement.

All Temporary Placements are engaged on a short term one (1) off basis. The Carer/Domestic is paid by the hour and paid as agreed upon by the Client and the Agency at the end of each week of the Temporary Shift.

Trial Period Policy: If a Carer/Domestic is engaged to work on a Trial Basis for more than one (1) day and the Placement does not become Permanent, the Fee charged will be for a Casual Booking Placement only and the Client will pay the Carer/Domestic at the end of their shift at the going rate per hour as set out by the Agency and agreed by the Client.

If the Placement does become Permanent the balance of the Temporary, Part Time and or Permanent Placement Fee will be charged and 40% of the Placement fee will be payable at time of confirmation by the Client and the Carer/Domestic in accordance with the Agency’s Fee Schedule and as set out in the Agency’s Term’s and Condition’s.

If a Carer/Domestic is engaged to work on a Trial Basis for one (1) day only and the Placement does not become Permanent the Fee charged will be for a Casual Placement only and is payable immediately.

If a Carer/Domestic is engaged to work on a Trial Basis and the Client cancels this Trial within 24 hours then the Client will be charged the Casual Booking Placement Fee and will also be liable to pay the Carer/Domestic a minimum of 4 hours at the going rate per hour as set out by the Agency. This amount will be debited to the Client’s nominated Credit Card on file.

Babysitting/Casual: All Babysitting/Casual Booking Fees are non refundable, non transferable and are to paid per booking

All Babysitter/Casual’s are employed on a daily basis only.

All Babysitting/Casual Placements are undertaken with the following Agreements.

An agreement has been completed with a Babysitter and the Client cancels within twenty four (24) hours of the Appointment Time regardless of the reason, the Client will need to pay the Agency Thirty Dollars Cancellation Fee and a minimum of three (3) hours of the hourly rate to the Babysitter as agreed upon between the Client and the Agency.

Hotels Bookings: The Client is required to pay the Agency the Booking Fee prior to the commencement of any Booking.

A minimum of three (3) hours for all Babysitting Bookings applies.

The Client is also required to reimburse the Carer/Domestic for parking fees incurred by the Carer/Domestic.

Overnight Care: All Overnight Care prices are available on enquiry.

Public Holidays: All Public Holidays including Christmas & New Year prices are available on enquiry.

Domestic: All Domestic help prices are available on enquiry.

Cancellation Policy

(1)          If the Client cancels a Casual Babysitting or Domestic Booking twelve (12) hours or less from the scheduled booking time, the Client will be liable to pay to the Agency an amount equal to four (4) hours at the relevant Carer/Domestic’s hourly rate.

(2)          If the Client cancels a Casual Babysitting or Domestic Booking Service forty eight (48) hours or more in advance, there will be no refund of the Placement Fee then paid and confirmed by the Agency to the Client.

(3)         If the Client cancels a Casual Babysitting or Domestic Booking Service Placement within twenty four (24) hours or less from the scheduled booking time the Placement Fee will be forfeited.

(4)          If the Client cancels either a Temporary, Part Time or a Full Time Permanent Placement within fourteen (14) days from the scheduled start time that has been confirmed and agreed upon by the Client, the Carer/Domestic and the Agency. The Agency will issue a cancellation fee of fifty per cent (50%) of the Placement Fee and will also include an invoice for Administration Charges of ($55.00) to cover all cost’s associated with the cancellation and is to be paid immediately upon receipt of this invoice and or can be charged to the Client’s nominated Credit Card on file.

(5)          If the Client cancels either a Temporary, Part Time and or a Full Time Permanent Placement within seven (7) days from the scheduled start time that has been confirmed and agreed upon by the Client, the Carer/Domestic and the Agency. The Agency will issue a cancellation invoice for 70% of the Placement Fee as set out in the Fee Schedule and will also include an invoice for Administration Charges of ($55.00) to cover all cost’s associated with the cancellation and the Client will also be liable to pay the Carer/Domestic one week’s salary that was agreed upon by the Client, the Carer/Domestic and the Agency at time of confirmation and is to be paid immediately upon receipt of this invoice and or can be charged to the Client’s nominated Credit Card.

(6)          If the Client cancels either a Temporary, Part Time or a Full Time Permanent Placement with less than forty eight (48) hours notice from the agreed start time that has been confirmed by the Client, the Carer/Domestic and the Agency, they will be issued with a tax invoice by the Agency for the Full Placement Fee as per the Agency’s Fee Schedule and the Client will be liable to pay the Carer/Domestic one weeks salary that was agreed upon by the Client, the Carer/Domestic and the Agency at time of confirmation and is to be paid immediately upon receipt of this invoice and or can be charged to the Client’s nominated Credit Card.

(7)           Cancellation of weekend Placements or Bookings must be made prior to 5.00pm on Fridays.

(8)         If the Client cancels a Wedding or Event Care Package within four (4) days of the scheduled booking date, the Client will be issued with a tax invoice by the Agency for fifty per cent (50%) of the Placement Fee.

(9)     The Client acknowledges and agrees that the Agency cannot be held responsible for cancellations or no-shows of a Carer/Domestic.

Replacement Guarantee and Refund Policy

(1)             Full Time and or Part Time Permanent Placement four (4) weeks guarantee only.

(2)       Subject to paragraph (2), if a Carer/Domestic introduced by the Agency resigns or has their  engagement by the Client terminated within four (4) weeks of commencing a Full Time or a Part Time Permanent Placement, the Agency must use all reasonable efforts to arrange for a replacement Carer/Domestic to be referred to the Client, at no additional cost to the Client.

(3)             Only one (1) replacement Carer/Domestic will be referred by the Agency under paragraph (1).

(4)           In the event that no suitable replacement Carer/Domestic can be found within three (3) weeks, the Agency will refund the percentage that is set out in Section (2) Under Refunds of the   Placement Fee to the Client.

(5)            A full refund of the Placement Fee will only be given to the Client if a Carer/Domestic fails to take up their Placement with the Client by the Scheduled commencement date.

(6)            The Client will not be entitled to a refund or replacement Carer/Domestic if the Client has failed to honour their previously agreed commencement date and the Carer/Domestic has had to seek an alternative Placement.

(7)           The replacement guarantee set out in this clause will not apply in the event a Carer/Domestic resigns due to unreasonable working conditions, mistreatment and /or by reason of misrepresentation by the Client.  

1              Refunds

If a Client has delayed the commencement start date from what is written into the Agreement, the Client will be liable to pay the Carer/Domestic for the weekly salary agreed upon from the original start date. The Agency deems that no refund of the Agencies Placement Fee will be payable.

2             Temporary, Part Time and or Full Time Permanent Placement Refunds

(1)            If a Client has delayed the commencement start date from what is written into the Agreement the Client will be liable to pay the Carer/Domestic the full weekly salary agreed upon as per the Client’s Agreement from the original start date. The Agency deems that no refund of the Agency’s Placement Fee will be payable.

(2)          If the Client has made an offer of either a Temporary, Part Time and or a Full Time Placement to the Carer/Domestic and they have accepted that offer, then the Client decides to withdraw the agreed offer either in writing or verbally, the Client will be liable to the Agency as follows.

(3)           If the due start date is fourteen (14) days from the date of cancellation, then fifty percent (50%) of the Full Placement Fee is payable to the Agency plus Administration Charges/Fees of ($55.00) plus one (1) week’s salary to the Carer/Domestic.

(4)           If the due start date is seven (7) days from the start date, then seventy percent (70%) of the Full Placement Fee is payable to the Agency plus Administration Charges/Fees of ($55.00) will be added to the final amount plus one (1) week’s salary to the Carer/Domestic.

(5)            If the Carer/Domestic cancels the Placement before the commencement date there will be no charge to the Client.

(6)            If a Termination occurs within one (1) week of Placement the Refund Fee will be fifty percent (50%)

(7)            If a Termination occurs within two (2) weeks of Placement the Refund Fee will be thirty percent (30%)

(8)            If a Termination occurs within three (3) weeks of Placement the Refund Fee will be ten percent (10%)

(9)            The Agency deems a Permanent Placement is satisfactory after the four (4) weeks trial period.

(10)        No refund or deduction from the Agency’s Fees will be provided to the Client if the Placement is reduced from Full Time to Part Time or Permanent to Temporary Placement or Part Time to Casual.

Deposit Booking Fee Policy:

(1)            The Deposit Booking Fee is:

(a)            non-refundable and non-transferable; and

(b)           will be deducted off the Placement Fee.

(2)          The Client must pay the Deposit Booking Fee to the Agency by direct deposit, PayPal and  Credit Card or such other means as requested by the Agency from time to time.

Late Payment Fee

The Client must pay a Late Payment Fee if the Placement Fee that is due and payable, but is not paid, to the Agency.

Advertising

If the Agency cannot find a suitable Carer/Domestic with any of the specific requirements needed by the Client and the Agency needs to advertise the position, the Client will need to give their approval in writing and will be required to pay for all advertising costs.

The Client will be invoiced for the cost of this advertising and will need to pay the Agency within seven (7) working days from the date of the invoice.

Casual bookings

The Client understands and agrees Agency Fees charged for all Casual Bookings are for one (1) booking only.

General

Any Carer/Domestic returning at a later date or the Client has extended the Placement will incur an extra change. The Client must notify the Agency as soon as possible within two (2) working days and pay the relevant Agency Placement or Booking Fee again in accordance with the Agencies Pricing Schedule.

The Client is responsible and liable for paying the Carer/Domestic at the end of each shift for all Casual Bookings Only.

If a Client has agreed on a Temporary Placement and the Carer/Domestic stays with the Client, the Client must notify the Agency immediately of the extended Agreement and will also be required to pay the Additional Full Fee for either the Part Time and or Full Time Permanent Placement as set out in the Pricing Schedule.

If a Client has agreed on a Temporary Placement for an agreed amount of time as per their registration form or verbally to the Agency and the Client has accepted that Temporary Placement and at a later date changes the Term of this Placement to a lesser and or fewer days/weeks/months then otherwise agreed upon by the Client as well as the Carer/Domestic and the Agency and the Agency has issued an invoice for the agreed Placement and the Client then Terminates this Placement, the Client will need to pay the Agency the agreed upon Placement Fee as per their invoice as set out in the Clients Fee Schedule in their Agreement and will need to pay this immediately.
